  • How Long Will My Family Law Case Take?

Common Divorce Myths

When you are going through a divorce, it often feels like everyone has an opinion or false knowledge of what actually goes on. Don’t fall for false truths and speak with an attorney to get the facts!
  • Myth All of your assets will be lost in the divorce if you commit adultery.

    False: This is not true. In a no-fault, no-contest divorce, judges often don’t even consider infidelity at all as a deciding factor in the division of assets. The courts will consider bad conduct during the marriage in the division of assets, but bad conduct for these purposes has more to do with hiding or losing assets.

  • Myth The children will get to decide for themselves which parent to live with.

    False: If the divorce is contested, it will actually be judges who determine the custody of the children, and in most of these cases, the mother will be the custodial parent, unless there is a definitive reason for custody to go to the father. For the most part, judges are not persuaded by the wishes of children. Only when they are older, of sound reasoning, and in the right circumstances, will they have an actual say.

  • Myth Women will always receive alimony in the event of a divorce.

    False: This is not the case. Alimony is most often paid to compensate a woman who has left the job market for a long period of time in order to raise children – it’s reasonable that they would have a hard time financially supporting themselves. Young, working women with no children will likely get no alimony.

  • Myth Having children will save your marriage

    False: Contemporary patterns suggest that this isn’t true. Experts admit that couples with children have a slightly lower risk of divorce, but couples aren’t “staying together for the kids” the way that they used to. Children also have the potential to drive a wedge between couples. Experts warn that the intense love you’ll have for your children can force you to always but them first, leading to marital demise.
